Estate Planning, Trusts + Wealth Transfer | Trust, Estate + Fiduciary Litigation
Asher counsels families and individuals in estate planning, estate and gift taxation, and charitable gift planning. He draws upon his extensive tax background to develop sophisticated wealth transfer strategies, tailor estate plans to minimize the gift and estate tax consequences associated with wealth transfer, and manage the creation of entities, private foundations, charitable remainder trusts, and other charitable giving mechanisms.
In addition to planning, Asher’s practice also includes estate, trust and fiduciary litigation. Asher represents both petitioners and respondents in matters involving trustee removal and surcharge, the validity of wills and trusts, prosecuting and defending against claims of financial abuse and breach of fiduciary duty, disputes concerning the characterization and distribution of trust and estate property, and the settlement of fiduciary accounting controversies.
Asher received his J.D. degree with a concentration in taxation from the University of California, Hastings College of Law where he was Valedictorian and earned Highest Honors. Thereafter, he spent five years with Baker, Manock & Jensen where his practice focused on providing sophisticated income tax planning solutions and corporate counsel to clients; representing clients during complex tax controversies in front of the Internal Revenue Service and state and local taxing authorities; corporate business transactions, and asset and real property transactions; and representing clients in civil cases before the California Superior Courts, California Courts of Appeals, the Ninth Circuit Court of Appeals, and the U.S. Bankruptcy Court, including serving on a trial team that secured a $36 million damages verdict and $88 million advisory unjust enrichment verdict after a 10 week jury trial.
Prior to graduating Summa Cum Laude from law school, Asher served for four years in the U.S. Army, 75th Ranger Regiment, which included three combat deployments to Afghanistan. Asher was subsequently ordered to active duty with the Army Reserves where he deployed to Iraq for nine-months and served as Squad Leader on a Commander’s Security Team. During his military service he earned the Bronze Star Medal and received numerous other notable awards and recognitions. He also served the City of Clovis as a Police Officer for five years.
Asher is admitted to practice in California, the Ninth Circuit Court of Appeals, and the United States Tax Court.
